Acting for a claimant.

You Get Nothing  …..not a nice position to be in.

If this has happened to you,  or if you have been left a benefit far below what you consider your true entitlement is then it is important that you get legal advice, and that you get it early.

Strict times frames apply.  Failure to comply with time frames could cost you your right to claim.   Furthermore, the longer it is left the make a claim the greater the likelihood that evidence may be difficult to obtain, or that the estate may be distributed.  You want to avoid these situations.  It takes time to gather, collate and consider the evidence in support of your claim.

It is important that the executors be formally advise of your proposed claim as soon a practicable.   If it appears that the executors intend to distribute you make need to consider making an application to the Court for an injunction or order preventing any distribution until your claim has been resolved.

Wills can also be contested on other grounds, including that the will was not validly signed, or that the deceased was not of sound mind when the Will was signed, and so forth.  Once again time constraints may apply.

We can advise you early, and can advise you what you need to have to make a successful claim.

Acting for the Estate.

We have on numerous occasions been acting in relation to an estate when a claim has been made on the estate.  It is important that the executors get advice early.  They have an obligation to carry out the wishes of the deceased,.  Not all claims are valid, and some claims are only minor and can be negotiated if dealt with promptly.

We will advise you, as an executor or administrator of an estate, of your rights and obligations.   You also have an obligation to look after the intrests of the beneficiary’s as set out in the Will, and we will advise you of the need to keep them informed along the way, and as to whether they need to consent to any settlement that affects their entitlement under the Will.
